Magic item creation

Lets say I (Joe the Archmage) has an Expanded Enchantment scroll. I put my circle of power down and I want to start my ritual. I want to take and place a Dragonsbreath spell in my item. Then I realize "oh no" the only dragonsbreath i have is a High Magic enhanced "elemental" Dragonsbreath. Would my ritual backlash as I attempt to place my elemental dragonsbreath into the item at the appropriate time?

several of us had an intereating discussion on it but I would like an ARC ruling on this if possible.

What if I did a "magic" dragonsbreath instead?
What if I used an item that had already a stored "dragonsbreath" ?

Thanks!

Your initial question (as well as using Magic Augmentation) has already been answered on this board for Spell Store, and the answer applies to Expanded Enchantment as well:

viewtopic.php?f=98&t=3729&p=58632&hilit=enchantment#p58632

As activating an Expanded Enchantment ritual (or a spell from a Spell Store ritual) will cause it to come out as (effectively) a "magic <spell>", it follows that that answer works for activated items as well.
