Judgements from the Minor Council

Lurin

Duke
To any interested, please find below two rulings from the Minor Council that are to be released as part of our efforts to clarify how laws are applied and what precedents have been set. As always nobility is not bound by these precedents but will generally be guided by them unless they have compelling reason to do otherwise.

On the False identification of potions and Elixirs

It has been decided that falsely identifying a potion or elixir, by design or mistake, allows the identified to be held culpable for issues arising from it's use.

Merchants who get items identified by a member of a certified guild-member are indemnified from said results as they are acting by fair standards. Merchants who depend on identification from other sources are not afforded this Privilege.

On the Dispatching of recognized monsters.

It has been determined that those hunting creatures recognized as evil acting by fair standards are entitled to any item found on the creature in cases where the source of the item cannot be traced. Land owners are not entitled to spoils, in full or in part, from such endeavors unless as defined by regional or future laws.

Kind regards,

Vigilance,
Freedman from the Northlunds.

Vigilance,

I have not been active in society in the resent past, can you please clarify what lands the Minor Council has governance over. Also as the Guild Assistant of the West Wayside Merchant Guild what is the certification process for our Guild members? In addition, in what ways can a member of a certified guild-member be identified?

Respectfully,
Aramis Seablade

Aramis,

Thank you for your inquiry. The Minor Council was created at the direction of Magistrate Simon Bovar to enact King Grimlocke's will in Fairhaven and surrounding territories. The Council's mandate is to provide a platform for small folk and gentry to have their cases heard and justice exacted by the attending nobles and guild leaders on behalf of the Crown. Duchess Fairfax has allowed the Council, at the direction of Baron Foss, to hold regular meetings in local establishments.

In response to your question, you, and verified members of the West Wayside Merchant Guild, are already certified by the Crown and, therefore, your Writ of Identification will indemnify merchants who sells your wares, and should protect any customer who purchases your wares. As for proper identification of members, that would be a matter for your guild to decide, though tabards, shingles, badges of office, or other regalia are often the standard. Has this been an issue?

Sub-Magistrate Vigilance and I, Magistrate Constance, will be working on behalf of Magistrate Bovar to brings claims before the Council, inform on any precedent or previous matters of law or opinion, record the proceedings, and dispatch news to the Duchess and the Crown. We have also been tasked with managing local estates, taxes, and acting as liaison to the adventuring community.

Feel free to voice any other questions you may have and Vigilance or I will answer as best we can. Thank you.

For Crown and Freedom,
Magistrate Constance
Manciple to Magistrate Bovar

Magistrate Constance,

Thank you for you responce and enlightenment. I do not know of any issues with the identification of our members but perhaps with this new ruling we will search out a way of making it clear to everyone our membership.
